A prefab offer may say that its small size removes the need for an energy certificate. Before accepting that explanation, ask which rule is being used and how it applies to your building. Floor area matters, but it is not the only condition of this exclusion.
The Spanish rule has two conditions
Article 3.2.d of Royal Decree 390/2021 excludes from its scope independent buildings not in contact with other buildings and with a total useful floor area below 50 m². It does not say that every small dwelling within a building is excluded. Nor does “below 50” mean “50 or less”.
Check which area you are being shown
As an editorial purchasing check, place the advertisement alongside a plan identifying useful floor area and the calculation basis. An external measurement or commercial model name is not a sufficient answer to a condition expressed in useful floor area. Ask the professional to review the configuration of the whole building too.
A certificate is not a planning permission or a consumption figure
This exclusion belongs to the energy-certification procedure. It does not establish planning compatibility or the home’s thermal performance. The CTE has separate energy-saving documentation; its application to the project must be assessed separately. Being outside one procedure does not demonstrate a low energy bill.
Use it to compare two offers
Request the same information from both sellers: plan, configuration, explanation of whether certification applies and the person responsible for checking it. If a rating is offered, ask for the document and its connection to the actual building and conditions. Do not translate “not mandatory” into “verified performance” or “nothing needs justification”. For Spain, confirm the applicable procedure with the professional and competent authority; do not transfer this rule to another country.
A checklist to take to the conversation
| Sales statement | Useful check |
|---|---|
| “It is below 50 m²” | Useful floor area of which complete building? |
| “It is independent” | Is it in contact with other buildings? |
| “No certificate needed” | Which situation and procedure were assessed? |
| “It uses very little energy” | Which calculation or measurement supports this? |
